STUARTS DRAFT, Va. (WVIR) - An Augusta County judge on Monday suppressed evidence against a Stuarts Draft man facing dozens of counts of child pornography. The judge ruled a hard drive could not be used as evidence in the case against 34-year-old Damian Eustler who was facing more than 100 charges.

The judge said investigators took too long to get a search warrant allegedly 41-days for the hard drive they had in their possession. Prosecutors say that hard drive contained thousands of child porn images.

Eutsler is still facing some charges due to images on a cell phone. His case is set for a jury trial in February.
