ALBEMARLE COUNTY, Va. (WVIR) - A former University of Virginia film professor will now serve his sentence behind bars.

Tuesday, October 2, a judge in Albemarle Circuit Court ordered 75-year-old Walter Francis Korte Jr. to report to jail by 6 p.m.

Korte had entered a plea agreement back in January 2018, and pleaded guilty to two counts of possessing child pornography.

The defense has tried to sway the judge to keep Korte out of jail: They have cited his age, lack of prior arrests, and that Korte has been out on bail for two years without issue. As a result, they asked the judge to let Korte stay at home, though with a monitoring device.

The commonwealth strongly disagreed with the defense's request, arguing Korte shouldn't get special treatment because of age or status in the community. During a previous court hearing, the commonwealth stated the former professor was not a threat to the public, but asked he be sentenced to as much as 12 months.

Korte was technically sentenced to five years per charge, but the judge suspended all but six months each. As a result, the former professor received an active sentence of 12 months total, minus time already served. The defense asked for the judge to reconsider, to which he said he says he would potentially re-visit later down the road.
