Former Nursing Assistant Enters Alford Plea in Albemarle Rape Case

A former nursing assistant has been convicted on a rape charge involving an 85-year-old woman at a Charlottesville retirement community.

Martin Matthews Martin appeared in Albemarle County Circuit Court Wednesday morning. Martin, 67, entered an Alford Plea to one rape charge. That means he does not admit guilt, but will be sentenced as if he had pleaded guilty.

Martin was a nursing assistant at Our Lady of Peace in Charlottesville when the assault happened in August of last year. The victim was an incapacitated 85-year-old resident.

According to prosecutors, another nursing assistant heard a patient moaning loudly in pain. She then saw Martin sexually assaulting a patient.

The commonwealth's attorney told the court that Martin admitted to police he took advantage of the patient. He said he was stressed out because he did not have enough help that day.

Martin is scheduled to be sentenced on July 8. He could face up to life in prison.
