Bench Trial Set for Staunton Man Charged with Attempted Capital Murder

AUGUSTA COUNTY, Va (WVIR) -

A man charged with attempted capital murder of an officer will go to trial in Augusta County - but there won't be a jury. Derek Powell, 33, is scheduled for a bench trial July 29.

Powell, of Staunton, is accused of assaulting his girlfriend in Waynesboro last summer, stealing her car, and leading police on a high-speed chase.

Deputies say Powell caused two crashes during the chase, forcing them to shoot out his tires.

Powell is charged with two counts of attempted capital murder of law enforcement, and two counts of failing to stop at the scene of an accident.
