Judge: Controversial Madison Document Does Not Fall Under FOIA

MADISON COUNTY, Va (WVIR) -

A Madison judge says a letter about a pay raise for the county administrator will stay private. Thursday's ruling undoes the legal attempt by two former supervisors who wanted a copy and filed a Freedom of Information Act request to get it.

Supervisors Jerry Butler and Pete Elliot wanted access to the document they say should have been given to them in December of last year. They believe it contains information regarding an increase to the county supervisor's salary. They say it was given to all of the other members of the current and former Boards of Supervisors and got approval without their knowledge.

Judge Dale Durrer says the letter concerning Ernest Hoch falls within a narrow exemption of the open records law and will remain private in Hoch's personnel records.
