Attempted Capital Murder Charges Move Forward against Staunton Man

STAUNTON, Va (WVIR) -

A Staunton man now faces prosecution after being charged with attempted capital murder.

An Augusta County jury felt the evidence was sufficient to try 33-year-old Derek Powell. Last summer, Powell allegedly assaulted his girlfriend in Waynesboro and stole her car. State police say Powell then crashed into a U-Haul on Route 250.

Then Augusta County deputies say they responded to Folly Mills, where Powell was spotted, and shot out his tires as he escaped. After another alleged accident on Route 11, deputies stopped Powell and arrested him.

Powell is charged with two counts of attempted capital murder of law enforcement and another two of failing to stop at the scene of an accident.
