Federal Court OKs Liquor Ads in VA College Papers

RICHMOND, Va. (AP) - A federal appeals court says two Virginia college newspapers can run advertisements for alcohol despite a regulation the state says is intended to curb illegal underage drinking.

The 4th U.S. District Court of Appeals in Richmond on Wednesday concluded that the Virginia Alcoholic Beverage Control Commission ban is unconstitutional as it applies to The Cavalier Daily at the University of Virginia and the Collegiate Times at Virginia Tech.

The court said the regulation violated their First Amendment rights because it prohibits a large number of those over 21 years of age from receiving truthful information about a product that they are legally allowed to consume. The majority of readers of both newspapers are aged 21 or older.

The ruling reversed a lower court decision that upheld the ban.
