The man shot by Albemarle police on Charlottesville's Birdwood Court in May will fight the charges against him.
Josue Salinas Valdez faces two felonies and two misdemeanors, after police say a hit-and-run investigation turned violent.
A release from the commonwealth's attorney's office Monday gave a clearer picture of the investigation. It included a list of the video and audio evidence used to obtain indictments against Salinas Valdez. But his attorney says Salinas Valdez looks forward to clearing his name in court.
Salinas Valdez was indicted by a grand jury on four charges Monday, including DUI, felony hit-and-run, assault of a law enforcement officer, and attempted malicious wounding of a law enforcement officer. He made his first appearance inside Charlottesville Circuit Court Tuesday afternoon.
Police say on May 26, Salinas Valdez fled the scene of a hit-and-run, leading police to a home on Birdwood Court, where investigators say he violently resisted arrest before an officer shot him in the abdomen. But Salinas Valdez's attorney, Greg Webb, maintains there is another side to this story.
"I think there are a lot of facts that need to be discovered, a lot that needs to be determined about what occurred in the moments before the shooting and about why the shooting occurred," Webb said.
Salinas Valdez spent more than a week in the hospital after the shooting. His attorney says he is recovering well, and has not ruled out a civil suit against the officers involved.
Albemarle County police say one of those officers is back on duty. The officer that pulled the trigger is still on administrative leave, and an internal investigation into the shooting is still underway.
Salinas Valdez plans to retain a criminal defense attorney within the next two weeks. He will be back in court July 16.
