The trial for an Albemarle County man accused in a deadly car accident will not be delayed.
Thomas Appleton, 25, of Crozet is charged with reckless driving in an accident on Garth Road that left Samuel Taylor dead.
The prosecution says Appleton and Taylor were racing, though that's something with which the defense takes issue.
Appleton's lawyer asked for a delay in the trial so more toxicology tests could be completed on Taylor - but Judge Cheryl Higgins denied that motion Thursday.
The trial is set for July 16.
