The case against a Barboursville man accused of abducting a woman in downtown Charlottesville last December carries on.
The case was originally scheduled for one day, but will stretch into its fourth day Friday.
The timing of this jury trial has been completely unpredictable. A case estimated to take one day has now consumed most of this week - and we're not even to closing arguments yet.
This is very much a "he said, she said" situation, and we got the defendant's point of view Thursday afternoon. The commonwealth says 52-year-old Mark Weiner had bad intentions when he offered a ride to a 20-year-old woman outside of the Lucky 7 in December, before taking her to an abandoned house on Pantops Mountain.
Weiner took the stand Thursday, refuting virtually all of those claims. He admits he gave the woman a ride to an apartment complex on Pantops, but says that's where the story ends, and no foul play was involved.
The problem in this case is there is very little hard evidence to go on. There is a string of text messages that allege Weiner tried to "get in [the victim's] pants," and surveillance video that puts Weiner's truck on Pantops that evening.
But the defense argues the woman was trying to make her boyfriend jealous, denouncing the commonwealth's arguments as "sinister" and "baseless."
All evidence was presented in the trial by Thursday evening. The trial will resume Friday at 9 a.m. in Albemarle County Circuit Court for jury instructions, closing arguments and deliberations.
