A he said, she said case unfolded in Albemarle County Circuit Court. The trial continues for a man charged with abducting a 20-year-old and taking her to an abandoned house.
The commonwealth says Mark Weiner had bad intentions when he offered the victim a ride. The defense says the woman was trying to make her boyfriend jealous.
Weiner is facing one count of felony abduction with the intent to defile, which carries a possible life sentence.
Prosecutors say Weiner gave the victim a ride last December in the Lucky 7 parking lot in Charlottesville, drugged her, and then took her to an abandoned house along Richmond Road on Pantops Mountain.
The jury has very little forensic evidence to rely on in the case. Text messages from the victim to her boyfriend show she got in the car and claimed Weiner tried to "get in her pants." On the same phone, the prosecutor says Weiner sent messages about how "sexy" the victim looked once she passed out.
Wednesday was day two of the trial that was supposed to last only one day. The trial will continue Thursday.
