There are more details on the shooting outside the Elks Lodge on Second Street Northwest in March.
Franklin Donnett Brown was not able to appear in court Thursday afternoon because he is still in the hospital recovering from gunshot wounds.
Police say a Charlottesville police officer shot Brown after Brown shot Leon Brock.
Commonwealth's Attorney Dave Chapman told the court Brown may be released in the next week.
Brown is now scheduled to appear in court on May 30.
