Dumler Asks for Case to be Dismissed Week Before Trial

Just days before he goes to trial, the Albemarle County supervisor who pleaded guilty to sexual battery is asking for his case to be dismissed. Chris Dumler filed the request this week, ahead of his upcoming trial on May 20.

In January, Dumler pleaded guilty to misdemeanor sexual battery - after being originally charged with forcible sodomy. Despite a wave of calls for his resignation, Dumler refused to resign from the board. A petition to remove Dumler was organized, and enough signatures were gathered for it to be legally binding. Now, it will be up to the court to decide whether or not he can keep his job on the Board of Supervisors. 

Last month, a circuit court judge ruled that a petition seeking his removal from office will move forward. The petition claims Dumler's conviction has hindered his ability to hold an elected office.

A court clerk says the dismissal request will be heard on Monday.
