The Virginia Supreme Court has dismissed the case between Albemarle County and a group of former employees.
Thirteen former workers sued the county claiming they never received the early retirement benefits they claim were promised them. They said they had agreed to an early retirement package when the county was looking to reduce staff and expenses. The county said it had cut some of those benefits due to a clerical error.
The former employees sued and won their case in late 2011, but the county appealed.
Thursday's ruling says the employees failed to give the county enough notice of the impending lawsuit and ordered the award tossed out.
The Supreme Court's ruling specifies the suit cannot be re-filed.
