The attorney for a homeless man facing attempted murder charges will not get to give the jury unusual instructions about sentencing options.
Samuel Wheless is accused of drawing a gun on a man on Charlottesville's downtown mall last August. During the incident, a female victim said Wheless inappropriately touched her. The victim's friend confronted Wheless and police say Wheless pulled out a gun and pointed it at him.
Thursday, Judge Edward Hogshire rejected defense motions that would have let jurors review the state's sentencing guidelines.
Wheless' trial is set for April.
