Motion Heard in Wheless Attempted Murder Case

Posted: Updated: Mar 07, 2013 02:46 PM

The attorney for a man facing attempted murder charges will not get to give the jury unusual instructions about sentencing options.

Samuel Wheless is accused of drawing a gun on a man on Charlottesville's downtown mall last August. During the incident, a female victim said Wheless inappropriately touched her. The victim's friend confronted Wheless and police say Wheless pulled out a gun and pointed it at him.

Thursday, Judge Edward Hogshire rejected defense motions that would have let jurors review the state's sentencing guidelines.

Wheless' trial is set for April.

Editors note: This story was edited to correct references to Samuel Wheless being listed as homeless. Court records show he holds a Waynesboro address.
