Halfaday to Remain Jailed until He Moves, Probation to be Transferred

A former Charlottesville City Council candidate will remain behind bars.

James Halfaday had an unusual trial on a probation violation late Tuesday. Out of that hearing came disturbing revelations of partner abuse.

Halfaday did spend 10 days in jail because of election fraud, but it's the violation of his probation that has him in jail now for a lot longer. A judge revoked his suspended election fraud sentence Tuesday afternoon pending a future hearing.

Halfaday pleaded guilty last year to election fraud after he used a false address to certify his candidacy for council in 2011. As part of his probation, he was told to not have any contact with his partner.

In court, details of an abusive relationship between Halfaday and his partner emerged. Halfaday made a YouTube video showing the death of the couple's cat which then invited outraged people to contact Halfaday's partner.

Those in court also heard about an email that Halfaday sent to his partner with three pictures attached of their dogs next to vomit.

The prosecutor told the circuit court judge Halfaday used a cellphone GPS tracker – 15 pages long with multiple pings – to keep tabs on his partner. Details were also shared of jailhouse phone calls from Halfaday threatening to put a hit out on his partner.

The commonwealth asked for the full suspended sentence to be imposed. The judge said Halfaday will remain in jail until his probation can be transferred to Illinois, where he has family to help him.

Halfaday's mental health was also a big part of this case. A mental health evaluation reveals Halfaday has been diagnosed with both narcissistic and antisocial personality disorders. The judge wants to make sure it's treated.
