An Augusta County man has lost his right to stay out of jail, while he waits to be sentenced for aggravated manslaughter.
Kevin Matthew Muscarella, 30, pleaded no contest in October, after running a stop sign and fatally hitting Domino's Pizza driver Christopher Rubin in February 2011.
Muscarella was due back in court next month for sentencing, but a judge ordered Muscarella's arrest, after several weeks of attorneys and court officials failing to track him down.
The judge listened to both sides Monday, and will decide by Thursday whether Muscarella must stay in jail.
