Albemarle County zoning
laws are forcing a man to give up his chickens, but he's firing back with an
appeal to the law.
AJ Miller lives off
Bennington Road and has 12 chickens. After
researching county code, he could not find a law directly stating they are not
allowed.
A zoning code enforcement
officer then gave him a notice saying he cannot have chickens and needs to remove
them.
"I thought that's odd, so
I went back and redid the research we had originally done and found that it's
not a primary use, but as a right, it should be an accessory use to have
chickens as a hobby just like you'd have pets as any kind," Miller said.
The Albemarle County Planning
Commission plans to discuss the appeal at a meeting in September.
