UPDATE: Pedestrian Hit by BMW, Driver not Charged

UPDATE:  Following an investigation, police say the driver of the BMW will not be charged for hitting a pedestrian.

The driver ran into the 23-year-old victim Wednesday while she was crossing Fifth Street near Harris Road around 11AM. Police say the impact tossed the victim in the air.

Police say the victim is being treated for injuries that are not considered life-threatening at the University of Virginia Medical Center. 

ORIGINAL:  Charlottesville police are investigating an accident involving a pedestrian who was hit while talking on a cell phone. The accident happened at 10:54 Wednesday morning in the 1100 block of Fifth Street, near Harris Road.

Police say a 23-year-old female was walking across Fifth Street from the Willoughby Shopping Center while talking on her cell phone.  An SUV swerved to miss her, but a BMW behind the SUV hit the pedestrian.  

Police describe it as a 'low speed impact' but the victim did flip in the air after being hit.  The victim was conscious and talking when rescue crews arrived. She was taken to the University of Virginia Medical Center.    

Police say charges are pending against the driver of the BMW.

Fifth Street was closed for a period of time but has since reopened.
