New Domestic Violence Laws Go Into Effect

On July 01 many new state laws go into effect, including one that offers more protection for victims of domestic violence. Virginians can now file a protective order without being married to or having a child with someone who threatens them.

This legislation was fast tracked through the General Assembly after the murder of University of Virginia student, Yeardley Love, last year. Her boyfriend, George Huguely, is charged with her murder.

The Sexual Assault Resource Agency or SARA in Charlottesville councils victims of sexual assault and harassment. Executive Director, Margaret Mikkelsen, said the new law also makes it mandatory for violators to be arrested right away.

"That's new and that's really important to making people feel safe," Mikkelsen said.

While many agree the law is beneficial, filing a protective order isn't always easy. Vera McDaniel has experience with protective orders and said the ordeal is frustrating.

"There's just a lot of miscommunication, misunderstanding as to what those protective orders actually do," McDaniel said.

McDaniel recommends being organized.

"People, as far as the ones seeking the protective orders need to be very detailed. Need to keep notes, specific notes, dates, times. Witnesses are wonderful," McDaniel said.

And that's when agencies including the Sexual Assault Resource Agency can step in and help victims file a protective order.

"There is help there if you know about it and that's the important thing. Getting the word out that you don't have to know how to navigate the system there are people who will help you do that," Mikkelsen said.
